8Project Description: The owner is planning to retire and dismantle units two thermal units (2x30 MW) with a capacity of 60 MW. At present, the consultant is working on the feasibility studies, based on which action is due by the Q2 2018. As of now, these two units have already been shut down since March 2016 due to a steep rise in fuel oil prices making cost of generation extremely high and unacceptable. RFQs for civil work and dismantling services of various equipment are expected by the Q2 2018. There is a tentative proposal to set up a solar plant on the land area after the dismantling is over.

For the first time, an inventory has been built of all energy subsidies in India, apart from subsidies to nuclear power and large hydropower, which were excluded due to the lack of data. 8The reviewed subsidies are grouped according to the energy type they benefit: a) coal; b) oil and gas; c) renewable energy.

-- Since the determination of LNG pricing is highly complex, due to international price changes, varying cost of intermediary logistic services etc, secret comparables obtained from corporates are usually far from accurate and hence should not be applied for determination of arm’s length price of LNG, the industry is claiming.
-- Allowing use of secret comparables for non-commodities leads to a high number of disputes and unwarranted litigation.
 -- It is argued that developed countries, such as the US & UK have an official policy of not using secret comparables for any Arm’s Length Principle (ALP) evaluation.
8Then again, it is argued that since LNG falls in the same logical category as crude oil, it must have the same level of taxation as applied to crude il. The benefits of using LNG are far-reaching vis-a-vis the revenue loss to the exchequer.
-- International LNG prices are at least 20-25% lower than the crude oil (or petroleum fuels) on heat equivalent basis and thus go to reduce the cost of energy to end-consumer in addition to the forex saving, the argument goes.
-- Since customs duty on crude oil has already been made zero, import of LNG presently attracting 5% customs duty should also be exempt. Through Finance Act 2012, the government has exempted levy of Customs duty on import of LNG for power sector. However, this exemption should be extended to other sectors also.

Interested parties are advised to go through the vendor registration process with the owner.

The time for submission of pre-budget list of demands have begun
The following demands have been put up to the finance ministry on behalf of the power user sector:
8CENVAT credit be given on clean energy cess. There is a also a demand to withdraw excise duty on fly ash.
8A demand has gone out from the caustic soda industry for full exemption from customs duty on imported equipment used to set up captive power plants in India.
8Group tax filing by companies with multiple SPVs for renewable energy
8Eligibility period for generation of power for claiming tax holiday be extended from 31 March 2017 to say 31 March 2020, especially given the coal shortage and other problem being faced by the sector.
8The relevant provisions of Section 9 of the Income Tax Act, in force since 1976, have been interpreted by the Supreme Court in India requiring the taxpayer to also satisfy the condition of ‘rendering of service in India’ for being taxable in India. This provision should now apply prospectively. Alternatively, a provision be inserted to clarify that past transactions would not be re-opened or contested by the tax officers on the strength of this provision.
8A clear provision has been sought for getting cash refund of accumulated CENVAT under Deemed Export Project under International Competitive Bidding. It is suggested that deemed exports should also get the same status as physical exports for getting cash refund under Rule-5 of CENVAT Credit Rules.
8It is suggested that the definition of the term Capital Goods should be amended to include Capital Goods used outside factory and used in relation to manufacturing of final products or for handling & transportation of raw materials, such as coal or fly ash, as well as intermediate products and final products.
